Terms & Conditions WELCOME... TheDareClub is a unique social networking website that specializes in (challenging) "daring" its members to perform specific tasks. Dares are submitted by members and then reviewed by our staff. Many dares will be submitted by companies or individuals that wish to see the youth do good things. If cleared by the website they will then have an established reward credit value. The "dares" that are cleared and posted with credit values are positive in nature and generally focus on building confidence, community / social skills, environmental awareness, education of vast subjects, and of course HAVING FUN. The dares will be video recorded by the members to prove completion and then uploaded to the site for all members and visitors to view and comment. As the members attempt and/or complete the dares and upload them to the site they will get that dares "credit value". The more dares they try or complete the more credits they will get. Soon they will be able to redeem their credits for stuff. "This is it. ACCOUNT TERMS By using the TheDareClub.com web site ("Service"), a service of Kebo LLC, you are agreeing to be bound by the following terms and conditions. You (the member) take full responsibility for all your actions. Anything you film, anything you do. Don't be stupid. Kebo LLC & TheDareClub.com reserves the right to update and change the Terms & Conditions from time to time without notice. Any new features or upgrades that augment or enhance the current Service, including but not limited to the release of new tools and resources, programs, dares, and contests shall be subject to the Terms & Conditions. Continued use of the TheDareClub.com after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time at: http://thedareclub.com/terms.html You understand and agree that all dare attempts and completions are to be original and either filmed by the associated member or attempted by the associated member. TheDareClub has the right to review and discard any videos they see as to be falsely produced, edited, revised, or recycled. If TheDareClub encounters these types of videos it has the right to delete the associated members account at its sole discretion. In other words... Keep it real. Don't copy, or use someone else's videos as your own. You also understand and agree that Kebo LLC & TheDareClub have the right to use, delete, change, modify or discard any video dare or submission at its discretion. We may, but shall have no obligation to you to remove materials that we determine in our sole discretion to be unlawful, fraudulent, threatening, libelous, defamatory, obscene or otherwise objectionable, or which infringe or violate any person's intellectual property or other proprietary rights or these T&C's. Under no circumstances does TheDareClub have any obligation to you to check the accuracy or truthfulness of any materials, nor to monitor any Member's use of the TheDareClub service. You must "Accept" the terms and Conditions, otherwise known as the "disclosure" agreement in order to use the site and/or become a member. You must be 13 years or older to use this Service. You must be a human. Accounts registered by "bots" or other automated methods are not permitted. Your account may only be used by one person - a single login shared by multiple people is not permitted. You are responsible for maintaining the security of your account and password. Kebo LLC & TheDareClub cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You understand that pages from any part of the service/site may be promoted and linked by advertisement as this is how TheDareClub.com is able to provide this service/site to it's members for free. You may not use TheDareClub for any illegal or unauthorized purpose. You must not, in the use of the service, violate any laws in any jurisdiction (including but not limited to copyright laws). Violation of any of these agreements will result in the termination of your Account. While Waggle Labs prohibits such conduct and Content on the Service, you understand and agree that Kebo LLC & TheDareClub cannot be responsible for the Content posted on the Service and you nonetheless may be exposed to such materials. Except where prohibited by law, the members agree to give permission for TheDareclub.com to use it's pages and content for their advertising and promotional agencies, and those acting under their authority to use such members videos for advertising and/or publicity purposes in all media and formats now known or hereafter discovered, worldwide and on the world wide web, without notice, review, approval, or additional compensation. Members further agree that TheDareClub, its respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, suppliers, printers, distributors, and the respective officers, directors, employees, representatives and agents of each and any other person or entity related in any way to members video content and products will have no liability whatsoever for, and shall be held harmless by members (and parent/legal guardian if member is a minor) against, any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any video attempt or prize redemption, participation in this promotion, or while traveling to, preparing for or participating in any activity. The Product Entities expressly disclaim any responsibility or liability for injury or loss to any person or property in connection with the delivery and/or subsequent use of the products redeemed. TheDareClub makes no representation or warranty concerning the appearance, safety or performance of any product redeemed. Restrictions, conditions, and limitations apply. TheDareClub will not replace any lost or stolen products. You may not use other Members' personal information for purposes other than establishing contact that is reasonably expected to be welcomed by such other Members. You may not submit Materials of any third party without such third party's prior written consent, or materials that falsely express or imply that such materials are sponsored or endorsed by TheDareClub. You may not create a false or misleading identity (including, but not limited to, that of a TheDareClub employee or partner), or falsely state or otherwise misrepresent your affiliation with a person or entity, for the purpose of misleading others as to the identity of the sender or the origin of a message or to harvest or otherwise collect information about others. You may not transmit, email or post any material that contains in any form software viruses or such programs as including but not limited to, Trojan horses, worms, time bombs, cancel-bots, computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment. You may not use the TheDareClub service in any unlawful manner or in any other manner that could damage, disable, overburden or impair the website. You may not attempt to gain unauthorized access to the TheDareClub service, other accounts, computer systems or networks connected to the TheDareClub service, through password mining or any other means. You may not modify, adapt, translate, or reverse engineer any portion of the TheDareClub Service, or use any robot, spider, site search/retrieval application, or other device to retrieve or index any portion or the TheDareClub service. You may not reformat or frame any portion of the web pages that are part of the TheDareClub Service. You may not disseminate content that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary right of any party or infringes any intellectual property law or any other applicable law. You may not remove any copyright, trademark or other proprietary rights notices contained in or on the TheDareClub Service. You may not disseminate any unsolicited or unauthorized advertising, promotional materials, 'junk mail', 'spam', 'chain letters', 'pyramid schemes', or any other form of such solicitation. You may not harvest or collect email addresses or other contact information of Members, including nicknames, from the website by electronic or other means. You may not invite or entice people who are not allowed to participate in TheDareClub services. CANCELLATION AND TERMINATION You are solely responsible for properly canceling your account. An email or phone request to cancel your account is not considered cancellation. You can cancel your account at any time by contactus@thedareclub.com from the same email address you used to create your account. This process is a simple, no questions asked instant cancellation process. Upon cancellation messages will no longer be transmitted to you in any form. Kebo LLC & TheDareClub, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the service, or any other Kebo LLC & TheDareClub service, for any reason at any time. Such termination of the service will result in the deactivation or deletion of your account or your access to your account, and the forfeiture and relinquishment of all content in your account. TheDareClub reserves the right to refuse service to anyone for any reason at any time. GENERAL CONDITIONS You expressly understand and agree that Kebo LLC & TheDareClub shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if TheDareClub has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) termination of your account; or (vi) any other matter relating to the service.
